TERMS AND CONDITIONS

These terms and conditions are applicable to all Contracts of any kind made by Dar Zemora Maison d’hote (DZ) and its guests (guests) and apply to all reservations, bookings and use of hotel services provided by DZ.

Guests are invited to read these provisions and note their responsibilities, arrangement of payments, cancellation terms and limitations on the liability of DZ. The contract is conditional on the receipt of the guest’s credit card details or deposit.

In these terms and conditions:

  • Accommodation means the four suites and three double bedrooms described on the DZ website
  • Arrival means the date on which the accommodation and hotel services to be provided shall start to be provided by DZ.
  • Contract means the contract for the provision of accommodation and hotel services.
  • Credit card details means the name of the card holder, the number of the card, the expiry date of the card, the security number and the address to which the statement is forwarded.
  • Departure means the date on which the accommodation and hotel services shall cease to be provided by DZ
  • Deposit means monies received in advance of arrival.
  • DZ means the accommodation and hotel services provided by Dar Zemora Maison d’hote S.A.R.L in respect of the boutique hotel named Dar Zemora and located in the Palmeraie, Marrakech.
  • Guest means the person with whom DZ has agreed to provide accommodation and hotel services.
  • Hotel Services means the provision of accommodation, other services provided by a boutique hotel and described on the DZ website, and as generally provided to guests by DZ.
  • Standard Charges means those charges shown on published literature within DZ relating to its hotel services in force from time to time.
  • The charges payable by the guest for the provision of the accommodation are as set out on the invoice.
  • The charges payable by the guest for ordering food and beverage, laundry, and spa services are the Standard Charges displayed on published literature within DZ relating to the services on offer from time to time.
  • DZ may vary the Standard Charges from time to time.
  • Charges for Accommodation and other services are inclusive of Moroccan Government taxes.
  • A Service charge is not added. This is at the discretion of the Guest.
  • Deposits are only taken for exclusive use and high season periods but valid credit card details are taken as a guarantee on confirmation.
  • No deposit is taken against any potential damage liability.
  • The accommodation payments to DZ are to be made by the guest (less deposits) on departure.
  • Charges for hotel services due to DZ from the guest shall be paid by the guest on presentation of an invoice. All charges to be settled prior to the guests departure. The guest is deemed to have authorised the settling of all outstanding charges which can be processed by DZ using any credit card details held on file.
  • DZ accepts the following credit cards: Visa, MasterCard and AMEX.
  • The guest agrees to pay charges to DZ in the event of cancellation of accommodation or hotel services.
  • 30 – 21 days prior to arrival 30% taken is taken from the credit card
  • 20 – 15 days prior to arrival 50% taken
  • 14 – 7 days prior to arrival 75% taken
  • 6 days or under to arrival date 100% is taken
  • The cancellation charges for hotel services (ie where guests fail to take up any pre-ordered services) will be dealt with on an individual basis at DZ’s discretion.
  • Arrival and departure times are 2pm and 12 noon respectively. Other times by prior agreement.
  • The guest is responsible for the behaviour of his or her guests. The guest must comply with all reasonable requests of DZ and with any policies of DZ as may apply to the provision of its hotel services from time to time.
  • The guest is responsible for any damage caused by the guest to DZ or breakages, the cost of repair/replacement being reimbursed prior to the guests departure, (if the cost has been established by then, or immediately it has been, if later). It should be noted that the interiors of DZ have been designed for a luxurious private home and are not as resilient as those of a large hotel.
  • Children of all ages are welcome – on the simple understanding that the guest accepts full responsibility for their safety and any damage they may cause. There are two unfenced and unattended swimming pools and an unfenced fish pond along with other technical equipment within the grounds. The DZ children’s dining policy requires all children under 7 years of age to vacate the Dining Room and the Dining Terrace by 7pm each evening. DZ does not accept pets.
  • It is the guests responsibility to ensure that adequate insurance is in place to cover against the cost ofcancellation or assistance (including repatriation) in the event of accident or illness.
  • It is also the guests responsibility to be in possession of a passport which is valid for at least six months from the date of arrival in Morocco.
  • DZ cannot accept responsibility for any errors on the guests behalf.
  • When DZ arranges services supplied by a third party it does not accept liability for, or give any warranty in respect of those services. Any complaint should be directed to the person supplying those services.
  • Moroccan Law shall apply to this contract, and any dispute, claim or other matter in connection thereto, will need to be filed with and dealt by the courts of Morocco.
